1. Listing Requirements

This section sets out the rules that the Owner must comply with to have a Listing referenced and displayed to the public on our Site.

A Listing is referenced on our Site once the Owner has:

• Created a User account on the Site,
• Provided all required information for creating their User account, including as a Professional Owner,
• Completed the mandatory information relating to the Boat offered for rental:
  • At least one photo of the Boat,
  • Boat characteristics: model, manufacturer, capacity, safety equipment, optional extras,
  • Boat location: city, port, indicating whether the berth in the home port is included in the Rental and/or Sailing,
  • Owner status (private or professional) – noting that misrepresenting status is a misleading practice sanctionable under the Consumer Code,
  • Necessary nautical qualifications for operating the Boat in the case of a Rental or if professional crew presence is required,
  • Boat availability dates,
  • Daily Owner price set according to availability dates, the amount due per hour or per day in case of late return of the Boat, the security deposit required for the Rental, and any additional fees (linen, cleaning),
  • The cancellation conditions for the Rental or Co‑Sailing chosen by the Owner according to the options provided in Article 7.3. In the case of a Rental, the Owner price is freely set by them and includes the Click&Boat Commission.
• Unreservedly accepted the Terms of Use,
• Obtained validation of the Listing by the Click&Boat team (in compliance with listing format),
• Any Listing not complying with the aforementioned rules will be refused by Click&Boat and therefore not referenced on our Site.

2. Delisting Procedure

A Listing may be temporarily or permanently delisted:

• At the Owner’s request,
• In the event of deletion or suspension of the User/Owner account,
• In the event of improper or unlawful use of the Service, including payment issues (such as suspicion of money laundering),
• In case of breach of the Terms of Use, including but not limited to soliciting Users and/or concluding Rental and/or Co‑Sailing arrangements directly with them outside the Site’s reservation system,
• In case of failure to respond to booking requests and/or messages from other Users,
• In case of low ratings or poor reviews by other Users (1‑ or 2‑star ratings and/or comments indicating safety concerns, non-compliance of the Boat, or Owner behavior),

Delisting may also be accompanied by temporary blocking or permanent deletion of the concerned User account, as provided in our Terms of Use.

Click&Boat also reserves the right to suspend or delete any Listing or User account in the event of behavior jeopardizing the safety, trust, or integrity of the Site or the Service.

3. Listing Ranking Criteria

Listings displayed on the Click&Boat Site are by default ranked according to a score assigned to each Boat offer.

This score, automatically calculated every 24 hours, takes into account the following criteria:

• Search parameters entered by the User (e.g., dates, location, Boat types, capacity, price, etc.),
• Listing characteristics (e.g., availability, location, price, Boat type…),
• Quality of reviews and/or ratings left by previous Renters,
• Owner’s response rate and time,
• Frequency of bookings confirmed by the Owner,
• Owner requirements (e.g., minimum or maximum rental days, booking cut‑off times),
• User’s preferences and booking history (e.g., past bookings, viewed and saved Listings),
• History of cancellations and disputes involving the Owner,

The list of Listings displayed after each search on the Site can be refined by the User using filters available on the interface such as maximum daily price, location (home port), sailing type, Boat type, Boat length, capacity (number of persons), number of cabins, equipment, year of construction, booking options (instant confirmation), cancellation policy, Owner status (“Super Owner”), and other criteria.

No financial or ownership link influencing ranking:

• Click&Boat holds no equity interest in Owners listing on the Site.
• Click&Boat does not offer any paid promotion service to Owners that would highlight certain Listings or affect ranking in exchange for remuneration.
