We would like to take this opportunity to thank you for choosing PT OCEAN PURE CHARTER, and for the confidence shown in us. PT OCEAN PURE CHARTER will be responsible for the handling of your reservations from A to Z. The conditions mentioned below form an integral part of the contract entered with PT OCEAN PURE CHARTER. We would ask you to read carefully these conditions below and return a signed copy to confirm your reservation. Please feel free to contact us if you require any further clarification of these conditions. Please note: In the conditions below, and for simplification, PT OCEAN PURE CHARTER will be noted as “OCEAN PURE”.
The prices quoted on our website and in promotional materials provide an indication but are not classified as a contracted price. For contractual purposes, the following documents will be provided: A full quotation valid for 15 days and requiring confirmation by the client, a sample itinerary of the voyage and a copy of these general conditions.
The published list price for Ocean Pure is USD 7’500.00 per night and has the following inclusions and exclusions.
Included in the charter price:
• Full board accommodation for 10 passengers maximum.
• The land activities/excursions according to the program.
• All meals and snacks.
• Soft drinks, fresh juices, water, tea, Balinese coffee, espresso. • Diving activities.
• Transfer from/to embarkation/disembarkation airport.
• Government taxes.
• Fuel during the cruise.
Not included in the charter price:
• Hotels and meals before and after the cruise.
• Alcoholic drinks.
• Travel and diving insurance.
• Onboard purchases.
• Private tours.
• On-board telecommunications
• Crew and Cruise Director gratuities.
• Tips on board recommended (5% to 10% of published rates)
Each reservation needs to be confirmed by mail, either postal or electronic. Your reservation is confirmed on receipt of your signed contract documents in their entirety (quotation and general conditions) to the “OCEAN PURE” reservation center (fax, scanned email, letter), accompanied with your first payment. At this time your reservation with “OCEAN PURE” is validated. At this time, you will receive in return a confirmation from “OCEAN PURE” relating to your reservation. From this time on the rights and responsibilities of the contract, including these general conditions, will take effect in the best interests of both you the client, and “OCEAN PURE”.
2.2 DEPOSIT and PAYMENT of BALANCE
A first non-refundable deposit of 10% of the contract amount will be made to PT. OCEAN PURE CHARTER no later than 10 days after the agreement is made.
A second non-refundable deposit of 40% will be made no later than 120 days prior to the charter. Payment of the balance, 50%, must be made 90 days prior to the departure date. PT. OCEAN PURE CHARTER will not be responsible for any bank costs related to the transfers made by the clients for the cruise deposit or balance of payments. PT. OCEAN PURE CHARTER will automatically offer the berths to other guests if these stage payments are not received within the stated periods. If full payment of the balance is not received by these dates, PT. OCEAN PURE CHARTER may cancel the booking and enforce the cancellation policy as set out in the Cancellation Terms in section 2.3.
In the event of last minute bookings, full payment must be made at the time of booking if the reservation is made less than 90 days prior to departure.
In the case of a cancellation after the voyage has been confirmed, firstly, “OCEAN PURE” must be informed by phone or email followed in writing (signed fax acceptable). To determine the date of cancellation, the following business date of the signed fax or email will be used as the specific cancellation date. In the case of cancellation, the following conditions apply:
2.3.1 AMENDEMENT FEES
An administrative charge of 20% of the invoice will be charged if any changes are made to your booking 90 days or less prior to the departure date. The date that PT. OCEAN PURE CHARTER receives the alterations to your booking by electronic mail, will be the date used to determine whether or not a fee will be charged. On Saturdays, Sundays and public holidays the next working day will count.
No automatic insurance coverage is included in our services provided. We highly recommend a travel insurance policy covering cancellations, accidents and repatriation. This insurance should take into consideration the costs involved in accident treatment including hyperbaric treatment. In the case of a diving accident, or other accident, “OCEAN PURE” will not be held responsible and any requests for compensation will be refused.
Please note: Basic evacuation and diving accident insurance is now mandatory onboard OCEAN PURE.
2.4 CLAIMS and COMPLAINTS:
We would ask you, if you have observations, complaints or requests for reimbursement, to contact us within 10 days of the return from your voyage. Beyond this time, it becomes extremely difficult for us to intervene. All requests for reimbursement relating to additional services, or services invoiced but not provided, will be studied on presentation of documentation and additional information. In the case of litigation against “OCEAN PURE” legal jurisdiction will be in Denpasar Bali as “OCEAN PURE” is an Indonesian registered company.
2.5 CHANGE of PASSENGER:
If for some reason you are unable to travel, you have the right, in principle to transfer your voyage to another person. In this case the following conditions need to be met:
• The person replacing you accepts to assume the contract entered with “OCEAN
PURE”. The other companies involved in your voyage accept to make these changes (airline companies and hotels if applicable). The person replacing you must meet all the conditions required for the voyage. (Valid passport, visa, dive level etc.)
• The person replacing you must sign all the necessary contracts and general conditions for the voyage.
• The person replacing you agrees to pay the balance of the voyage remaining and any additional charges, which occur due to the name change.
In the case of a transfer, the client transferring their voyage place must inform “’OCEAN PURE” by signed fax or email no later than 7 working days before the departure date, and, indicate the reason for the changes, and present the replacement participant. A new contract will be entered with the new client in the fastest delay possible.
2.6 PROGRAMS and ITINERARIES
Full boat charters must respect the general program regarding the dates of the cruise. In effect, this relates to the date and departure point of the boat. The boat must imperatively leave and arrive at the locations of the general itinerary due to logistics for the following charters.

2.7 CHANGES IN BROCHURES, INTERNET SITE, PRICES and ITINERARIES.
“OCEAN PURE” reserves the right to modify brochures, website, list of services, itineraries and prices at any time up to the date of the contract conclusion. In this instance we will advise the client leading up to the conclusion of the contract. The validity date for the contract is based on the date of receipt of the payment deposit.
2.8 PRICE FLUCTUATIONS
“OCEAN PURE” may change the contract prices after the contract conclusion up to 31 days before the departure in the case of a sudden increase in the price of fuel of more than 15%.
2.9 ITINERARY and SERVICE CHANGES
“OCEAN PURE” reserves the right to change an itinerary or certain services due to unforeseen or inevitable circumstances (for example adverse weather conditions). “OCEAN PURE” will endeavor to compensate for these changes by offering an equivalent alternative. “OCEAN PURE” will notify the client as soon as these circumstances are known and how these circumstances may have an eventual effect on the price.
2.10 CANCELLATION CREATED by THE CLIENT.
“OCEAN PURE” reserves the right to cancel a client reservation if their excessive actions or behavior justify this action. In this case “OCEAN PURE” will not reimburse any of the amounts already paid. All complaints against “OCEAN PURE” will be contested.
2.11.1 UNFORESEEN EVENTS
“OCEAN PURE” reserves the right to modify, interrupt or cancel a charter when unforeseen events are imposed on the company or when the security of the travelling clients may be compromised. These may include but are not limited to: refusal or cancellation of flight landing rights, strikes, civil or international war, political or economic disturbances, terrorist threat or activity, fire, climatic, seismic or volcanic events. In any case you will be informed by “OCEAN PURE” as soon as is possible. In these cases, the traveler may not apply for reimbursement from “OCEAN PURE”. Travelers, who have foreseen travel insurance taking these unforeseen events into consideration, may request reimbursement directly with their respective insurance company.
2.11.2 COMPENSATION DUE TO INJURY, SICKNESS, DEATH or MATERIAL DAMAGE.
“OCEAN PURE” does not accept responsibility in the case of unforeseen events/force majeure.
The passenger must declare at the time of reservation that they do not suffer from any mental, physical, or other, disability that may put them, or other passengers at risk. “OCEAN PURE” reserves the right to refuse the contracted services to a passenger presenting these risks during a charter.
2.13 SCUBA DIVING SAFETY
For “OCEAN PURE” safety is of principal importance on all voyages. It is the client’s responsibility, as a certified diver, to respect and follow the guidelines given by the “OCEAN PURE” guides and instructors, plus to follow the regulations stipulated by their certification agency. Clients are solely responsible to provide a diving medical statement or physicians medical dated within the last 12 months, certification card and log book. Ignoring the directions given by the guides, or not presenting certification card, log book or valid medical paperwork may cause a limitation or disqualification from scuba diving on the voyage. The diver accepts their responsibility to be technically capable of participating in the activity of scuba diving and fully accepts the risks associated. We reserve the right, for safety reasons, and at the discretion of the “OCEAN PURE” guides, to refuse access to one/several dives if the diver does not have the necessary competence to participate safely.
An insurance policy covering accidents and repatriation is MANDATORY on “OCEAN PURE”. This insurance should take into consideration the costs involved in accident treatment including hyperbaric treatment. In the case of a diving accident, or other accident, where the accident was not caused by a service
provided by “OCEAN PURE” or their employees, “OCEAN PURE” will not be held responsible and any requests for compensation will be refused.
2.14 ALCOHOL AND SAFETY REGULATIONS
• Main rule – FIRST DRINK = LAST DIVE! (Including beer and wine)
• Captain and Cruise Director of OCEAN PURE maintain the right to change the route if they judge that the safety of the guests, crew or the boat is threatened. • No racist or religious offensive remarks towards the crew will be tolerated and the Captain and Cruise Director of OCEAN PURE maintain the right to stop the
trip if any occur.
• Any behaviour during the trip, that can put guest lives in danger – such as, but
not limited to, climbing on the mast or jumping from the boat without crew permission, approaching closer to Komodo dragons than allowed by guide or similar, will not be tolerated.
• Only Diving Instructors approved by P.T. OCEAN PURE CHARTER can teach dive courses during the cruise.
